Cycling Odyssey Terms and Conditions

Welcome to Cycling Odyssey!
Cycling Odyssey reserves the right to decline any request to join a ride without having to give a reason. On the rare occasion that you are declined and you have already paid, we will offer you a full refund within 24 hours.
These Terms and Conditions (“Terms”) govern your participation in our bicycle tours across Africa. By registering for a tour, you agree to be bound by these Terms.
- Code of Conduct
You agree to conduct yourself in a respectful and responsible manner during the tour. This includes obeying all traffic laws and regulations, following the instructions of our guides, and being considerate of other participants.
This includes respecting local customs and cultures throughout the tour.
Participants are expected to be considerate of the environment and wildlife.
Intoxication or substance abuse that could impair judgment is strictly prohibited.
- Safety Equipment
You are responsible for ensuring that your bicycle and all safety equipment, including helmets, lights, and reflective gear, are in proper working condition and meet all legal and safety requirements
In addition to your own safety equipment, we provide:
- Basic repair tools and spare parts for common bicycle issues.
- First-aid kits for minor injuries.
- Risk and Responsibility
3.1 Cancellation: We reserve the right to cancel any ride for any reason. In the event of cancellation on our part, we will offer you a full refund or the opportunity to reschedule.
We may cancel due to unforeseen circumstances beyond our control (e.g., natural disasters, political unrest, participant safety).
We will provide reasonable notice of cancellation and work with you to find a solution.
- If you decide to cancel, you will be entitled to a refund as follows.
50% of the full ride value if you cancel with more than 30 days to the ride - 75% of the full ride value if you cancel with more than 60 days to the ride
- 100% the full ride value if you cancel with more than 90 days of the ride
3.2 Rider Responsibility: You participate in our tours at your own risk. We are not responsible for any accidents, injuries, or property damage that occurs during the tour however caused.
You are responsible for following all safety instructions provided by our guides.
You agree to ride in a safe and responsible manner, avoiding reckless behavior.
You will ensure that you are properly hydrated and consumed appropriate nutrition before, during and after the ride(s)
3.3 Fitness: You confirm that you are physically fit and capable of participating in the tour. You must disclose any medical conditions or disabilities that could impact your safety on the tour.
We may require a doctor’s clearance for participants with certain medical conditions.
- Intellectual Property
Our logos, trademarks, photos, and other intellectual property associated with Cycling Odyssey tours are our exclusive property.
We may grant limited licenses for use of our intellectual property for specific purposes with written permission.
You agree not to infringe upon our intellectual property rights.
- Participant Images and Testimonials
You grant Cycling Odyssey the right to use your name, likeness, and photographs or videos taken during the tour for marketing and promotional purposes. This includes use on our website, social media channels, and other promotional materials.We retain the right to use your image and testimonials for marketing purposes.
You can opt out of having your image used by contacting us in writing at Rides@CyclingOdyssey.co.
We will not use your testimonials in a way that misrepresents your experience.
- Insurance
You are responsible for obtaining and maintaining any insurance coverage required for your participation, including personal health insurance.
We recommend obtaining the following insurance:
- Travel insurance to cover medical expenses, trip cancellation, and baggage loss.
- Personal accident insurance.
- Waiver and Release
By participating in the tour, you release Cycling Odyssey from any and all claims, liabilities, and demands arising out of or related to your participation, including but not limited to personal injury or property damage.
While we strive for your safety, you acknowledge the inherent risks of cycling tours. This waiver and release extends to claims against our guides, support staff, and volunteers.
- Emergency Procedures
8.1. We have procedures in place to handle medical emergencies during the tour. In the event of an accident or injury, we will contact emergency services and provide any necessary assistance.
Our emergency procedures include:
- Trained guides who can administer first aid and CPR.
- Communication protocols for contacting emergency services.
- Evacuation plans in case of unforeseen circumstances.
- 8.2 Accidents & Unexpected Weather: We have protocols for dealing with accidents and unexpected weather conditions. Our guides will provide instructions and ensure the safety of all participants.
- Termination of Participation
We reserve the right to terminate your participation in the tour if your conduct is deemed detrimental to the safety and enjoyment of other participants. We may terminate participation if you violate safety rules or pose a risk to yourself or others. In such cases, no refund will be provided.
- Governing Law
These Terms remain governed by the laws of Kenya. Disputes will be subject to the courts of Kenya.
- Entire Agreement
These Terms constitute the entire agreement between you and Cycling Odyssey.
- Dispute Resolution
We offer an alternative to litigation:
- We encourage participants to attempt to resolve any disputes with Cycling Odyssey amicably through mediation or arbitration before resorting to court.
By registering for a tour, you acknowledge that you have read and understood these Terms and Conditions.
